Xeko Privacy Policy

Privacy Protection.

The Xeko website located at www.xeko.com (the "Site") is owned and operated by Hairy Entertainment ("we" or "our"). We are providing you with this privacy policy ("Privacy Policy") to explain how we collect, use, disclose and protect the personal information that we receive and to reinforce our 100% commitment to making Xeko and the Site a safe place. This Privacy Policy applies only to the use and collection of data collected by the Site and does not apply to any other data collected by us online or offline.

Xeko adheres to the US Safe Harbor Privacy Principles of Notice, Choice, Onward Transfer, Security, Data Integrity, Access and Enforcement and is registered with the U.S. Department of Commerce's Safe Harbor Program. Information Collection.

When you or your child visit the Site, we will collect two types of information: certain limited personal information knowingly disclosed and collected by us concerning the user (the "User") and the User's parent or legal guardian ("Parent"), and certain anonymous Site-use information collected by us as you interact with our Site.

During the initial registration process ("Registration"), we only collect information we deem reasonably necessary for each User to play and interact safely within our environment, which information includes the User's date of birth, a User-created anonymous username ("User Name") and password ("Password"), and the email address of his/her Parent (the "User Information"). The provision of this User Information will allow the User to access and interact with the Site using his or her unique Username and Password, subject to Xeko Terms of Use and our receipt of verifiable Parental consent, if necessary. Xeko will never ask you for your password in any unsolicited communication.

Also, in connection with the establishment of a membership subscription, we will ask for and collect certain credit card and other payment account information from the User's Parent, which information includes the cardholder's full name, email address, and the applicable credit card billing information (the "Payment Information"). This Payment Information is used solely for purposes of processing subscription payments to Xeko and is not stored by us; rather, all collected Payment Information is stored by the applicable payment processor. Other than the User Information and the Payment Information, we will not request or require the collection of any additional information from, or concerning, any User in connection with the use of the Site. The User Information and Payment Information are sometimes collectively referred to in this Privacy Policy as, the "Personal Information."

In no event shall any User under the age of 13 obtain access to the Site unless and until we have obtained verifiable consent from such User's Parent in compliance with the Children's Online Privacy Protection Act of 1998 ("COPPA"). We also recommend that minors over the age of 13 ask their Parents' for permission before sending any information about themselves to anyone over the Internet.

We do not request or collect sensitive personal information, such as information about medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, or other sensitive information except in strict compliance with the Safe Harbor framework.

Upon the completion of Registration, and except as otherwise set forth in this Privacy policy, all communications between us and the User will be directed and kept within our internal networks and systems. In the event that a User or any other person contacts us via the "Contact Us" function at the Site, we will request that such person provide us with his or her name or User name, as applicable, and/or a corresponding email address so that we may respond to the inquiry, as necessary.

On occasion we may ask our Users to answer polls, trivia questions or submit User-generated content. These questions, polls, surveys and other User-generated content will pertain specifically to our Xeko environment or related interests and will be transmitted via our internal system. The information and content collected from these surveys, polls and/or solicitations will allow us to improve the User experience, content in our Site and personalization to Xeko without personally identifying the applicable User. We may also use this information to analyze Site usage, as well as to offer products, programs or services.

In the event that a User desires to send an electronic greeting card, mobile message or similar communication to another user or person, such User may be required to submit an e-mail address or mobile phone number to us in connection with such request. In no event will we use any such submitted information for any purpose other than sending the requested communication and such collected information will not be stored by us for a period of time that is longer than reasonably necessary to effect the requested communication.

In connection with certain newsletters, bulletins or other media that we send to Parents, we may request that such Parent(s) participate in various surveys, polls or other requests for information. Participation in all such campaigns is voluntary and each Parent may choose whether or not to participate or provide any or no information to us. Please be aware that all data is delivered to servers located in the United States and will be processed in the United States. Message Boards, Chat Rooms and Forums.

This Site makes chat rooms, forums, and message boards ("Public Forum") available to the Users, provided that we receive verifiable consent, if necessary, from such User's Parent specifically consenting to the User's access to the Site's Public Forum. Please remember that any information that is disclosed in the Public Forum becomes public information that is accessible to, and viewable by, any person obtaining access to the Site. Pursuant to COPPA, Users shall not post, upload or send any personally identifiable information concerning any User in, through, or to, any Public Forum. For our User's protection, we will make all reasonable efforts to moderate and screen all Public Forum content for violations of this policy, including, without limitation, the employ of a live moderator who shall moderate the flow of content disclosed in any Public Forum and, the use of an automated dictionary programmed to preemptively censor certain unauthorized content. Any User violating our Public Forum policy will permanently lose access to the Public Forum. In the event that any personally identifiable information is made available via the Public Forum in violation of this policy, we shall endeavor to immediately delete such information from the Public Forum.

Cookies.

Xeko does utilize "cookies" in order to store our User's preferences. A "cookie" is a piece of data stored on the user's computer tied to information about the User. We use "cookies" to determine how many visitors we have and how often they visit various sections of our Site. Additionally, it enables us to customize your experience as a return User. Do keep in mind that "cookies" do not contain any personally identifiable information. You can remove or block this "cookie" using the settings in your browser if you want to disable this convenience feature. If you choose to disable this "cookie," your experience at our Site may be diminished and some features may not work as intended.

How We Use That Collected Personal Information

In addition to the uses described above, we may transfer the personally identifiable information that we collect and maintain to certain of our agents or service providers to help us bring our Users the services that we offer; provided, where we utilize third parties for the processing of any personally identifiable information, we require that such processing comply with this Privacy Policy and we implement reasonable contractual and technical protections limiting the use of that personally identifiable information to our specified purposes. Please be aware that certain personally identifiable information may be stored outside of the jurisdiction in which a User is located and, although such personally identifiable information will be protected by the security measures described in this Privacy Policy, it will also be subject to local laws.

We may use the email address on record that relates to a User's Parent in order to contact such Parent to provide information regarding such Parent's child, the Site, or the use hereof, to provide Site-related bulletins, newsletters or other media to the Parent, and/or request that such Parent participate in a poll, survey or other request for information.

We do not use personally identifiable information for purposes incompatible with the purposes for which the personally identifiable information was originally collected without notifying the relevant persons of such uses and offering an opportunity to opt out.

When required by law, we will disclose any personally identifiable information that we maintain, for example, in response to a court order or a subpoena. We may also disclose such personally identifiable information in response to a law enforcement agency's or other public agency's (including school's or children's services) request or if we feel that such disclosure may prevent the instigation or commission of a crime. Additionally, we reserve the right to transfer any and all personally identifiable information in the event that our company is acquired by, sold to, or merged with another company; provided, we will provide notice before any personally identifiable information is transferred and becomes subject to a different privacy policy.

We make good faith efforts to provide Users, or their Parents, with access to their personally identifiable information and either correct this data if it is inaccurate or to delete such data if it is not otherwise required to be retained by law or for legitimate business purposes. Parents whose children have provided personally identifiable information to us may review, correct, update and delete the information provided by their child, or concerning their child, at any time, by sending an e-mail message to privacy@goodeggstudios.com. For verification and security purposes, we may request that such parental requests contain the Parent's email address and user's elf name, supplied by us during Registration as well as a valid e-mail address, a street address, or a phone number, which contact information is collected solely for purposes of contacting the Parent and shall not be used for any other purpose or stored by us for a period of time longer than is necessary to contact such person. If such a parental request is received, we will make all reasonable efforts to delete the information from its files.

3rd party Sharing, or Solicitation.

We will not sell, rent, or transfer any Personal Information or other personally identifiable information relating to any User, or his or her Parent, to any third party, or use any such information in ways that are materially inconsistent with the terms and provision of this Privacy Policy. If there are material changes to this specific policy, we will provide parental notice of the applicable changes via email notification and obtain Parental consent prior to sharing or transferring any such personally identifiable information.

With your consent, we may share certain Parent-related information that we collect with our non-profit partners so they might share information regarding their entity and their activities.

Security.

Xeko will take appropriate measure to maintain a safe and secure environment for our Users. We make all reasonable efforts to uphold the highest standards with our Site, the personally identifiable information we collect and the security we offer.

Data Integrity

We take reasonable steps to ensure that the personally identifiable information that we collect is relevant for the purposes for which it is to be used and that the personally identifiable information is reliable for its intended use and is accurate, complete and current. We depend on our Users, and their Parents, to update or correct personally identifiable information whenever necessary.

Parental Surveys

In connection with certain newsletters, bulletins or other media that we send to Parents, we may request that such Parent(s) participate in various surveys, polls or other requests for information. Participation in all such campaigns is voluntary and each Parent may choose whether or not to participate or provide any or no information to us. Any information that is voluntarily provided to us by a Parent in connection with any such campaign may be shared by us with third parties in our sole discretion, provided that we will disclose the identity of all such third parties and the purpose of the applicable request for information prior to the collection thereof. Notwithstanding this sharing of information, we will NEVER share with a third party any such information that is coupled or linked to the identity of a Parent or User or any other personally identifiable information.

California Users

Enforcement and Oversight

Xeko has established procedures for periodically verifying implementation of, and our compliance with, this Privacy Policy. We conduct an annual self-assessment of our practices with respect to the personally identifiable information we collect to verify that representations we make about our privacy practices are true and that the related privacy policies have been implemented as represented. Users and/or their Parent may file a complaint with our Privacy Officer in connection with our processing of any personally identifiable information. If any such complaint cannot be resolved through our internal process, we will cooperate with the appropriate regulatory authorities to resolve any complaints regarding the transfer of personally identifiable information that cannot be resolved between Hairy Entertainment and the individual.

Changes to the Privacy Policy.

Xeko's Privacy Policy was last updated on November 23, 2009. Hairy Entertainment reserves the right to change or update the Privacy Policy at any time. Please be advised we will not reduce your rights under this Privacy Policy without your explicit consent, and we expect that most such changes will be minor. Regardless, we will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain matters, email notification of Privacy Policy changes). To ensure that you are up to date on all matters related to this Privacy Policy, please periodically review this page for changes and updates. The effective date of any such change and of the Privacy Policy will be clearly marked.
